She Got 7 Life Terms: Her 11-Year-Old Daughter Gave Birth To Her Husband’s Baby
Her 11-Year-Old Daughter Gave Birth To Her Husband’s Baby. She Got 7 Life Terms.
An 11-year-old girl gave birth inside a home near South Main Street and West Southside Boulevard in Muskogee, Oklahoma, without prenatal care or medical assistance. The child was subsequently taken to a hospital, where medical personnel discovered that she had not received prenatal care and had not been examined by a doctor in more than a year.
Investigators learned that the girl was living with her mother, Cherie Dawn Walker, her stepfather, Dustin Joel Walker, and five younger siblings, ages 9, 7, 6, 4, and 2.
The investigation revealed that the children had allegedly been living in severely neglected conditions. Court documents described a home littered with dog feces, trash, and other filth. Investigators also reported that some of the children lacked adequate clothing.
A neighbor claimed the residence had been without running water for two to three years and that she had contacted authorities multiple times because of concerns about the children’s welfare.
Investigators later learned that child protective services had attempted to enter the home several times while the 11-year-old was pregnant but had never been permitted inside.
When initially questioned, Cherie and Dustin maintained that they had no knowledge of the child’s pregnancy. They also claimed they did not know who had fathered the baby.
On August 19, 2025, prosecutors filed criminal charges against the couple. Both were initially charged with six felony counts of child neglect, one involving the 11-year-old and five involving her younger siblings.
On August 25, 2025, DNA testing confirmed that Dustin was the father of the baby born to his 11-year-old stepdaughter.
Following the results, Dustin was charged with S.A. of a child under 12, while Cherie was charged with enabling C.S.A. Prosecutors alleged that Cherie knew her husband was abusing her daughter but failed to intervene or protect her.
The investigation also uncovered allegations that other family members had been aware of the pregnancy.
On August 29, 2025, prosecutors charged the children’s maternal grandmother, Michelle Lynn Justus, with six felony counts of child neglect.
Justus lived across the street from the family and was reportedly involved in caring for the children. Prosecutors alleged that she had regular contact with her grandchildren, saw the 11-year-old almost daily, and failed to report the pregnancy or protect the children from the conditions inside the home.
Justus denied knowing about the pregnancy and maintained that the family had been unaware of what was happening.
All six children were removed from the home following the investigation.
On January 30, 2026, testimony during a preliminary hearing revealed additional information about the family’s living conditions and what relatives allegedly knew before the child’s delivery.
A Department of Human Services employee described the home as deplorable and testified that child protective services had attempted to enter the residence multiple times during the pregnancy but were never allowed inside.
Investigators also presented statements from one of the younger children, who reportedly told authorities that family members knew her older sister was pregnant.
According to the testimony, the younger girl had drawn a picture depicting her sister pregnant. She also alleged that Justus had instructed the children not to tell anyone about the pregnancy.
The testimony contradicted the adults’ earlier claims that nobody knew the 11-year-old was expecting a baby.
On March 26, 2026, Dustin pleaded guilty to one count of S.A. of a child under 12 and six counts of felony child neglect. He entered the pleas without a negotiated sentencing agreement.
On June 29, 2026, Muskogee County District Judge Timothy King sentenced Dustin to life in prison for the S.A. conviction.
He also received 15 years for one count of child neglect, five years each for four additional neglect counts, and seven years for the remaining count.
The judge ordered the six neglect sentences, totaling 42 years, to be served consecutively before Dustin begins serving his life sentence. He was also ordered to have no contact with the victims and to comply with lifetime offender registration requirements.
On July 6, 2026, Dustin filed an application seeking to withdraw his guilty plea, despite already having been sentenced.
On July 13, 2026, Cherie’s jury trial began in Muskogee County District Court.
During the proceedings, prosecutors presented testimony from emergency responders, medical professionals, investigators, and child welfare employees. Jurors reviewed the original 911 call, medical records, DNA evidence, birth records, police body-camera footage, and photographs documenting conditions inside the family’s home.
The prosecution also introduced evidence concerning the residence’s water service and the children’s living conditions.
On July 16, 2026, a juvenile witness testified through video while the courtroom was closed to spectators. Jurors also reviewed a recorded interview and heard testimony from a therapist and pediatrician.
On July 17, 2026, the defense presented testimony from relatives, church members, and a pastor. The jury also reviewed photographs submitted by the defense.
Following closing arguments, jurors found Cherie guilty of one count of enabling C.S.A. and six counts of felony child neglect.
The jury recommended that she receive a life sentence for each of the seven convictions.
On July 28, 2026, Dustin withdrew his earlier application to withdraw his guilty plea. The court granted his request without objection, leaving his original convictions and sentences in place.
On August 17, 2026, Justus waived her right to a jury trial in the separate criminal case against her. She continued facing six felony counts of child neglect involving all six grandchildren.
On October 30, 2026, Cherie returned to Muskogee County District Court for formal sentencing.
Judge King imposed seven life sentences, one for enabling C.S.A. and one for each of the six child neglect convictions.
The judge ordered all seven life sentences to be served consecutively.
The sentence matched the punishment recommended by the jury following her July conviction.
Dustin remains sentenced to 42 years followed by life in prison for his convictions.
Justus has not been convicted. Her case remains pending, with a pretrial conference scheduled for November 19, 2026, and a bench trial scheduled to begin on January 12, 2027.
