RawNews1st – A woman convicted of going into a funeral home and cutting up the victim in the casket, then getting released from prison.
Has now been arrested again, now accused of assaulting her mother.
Shaynna Sims (aka Shaynna Smith) was arrested in Muskogee August 2nd.
The arrest report says Sims pushed her daughter, then kicked her mother in the thigh, threatened her mother with a fire extinguisher, swung a grill grate at her mother and threw a metal chair at her and sprayed white paint on both her mother and her daughter.
Sims is charged with domestic assault and battery with a dangerous weapon.
In 2017, Sims was convicted by a Tulsa County jury in the case of cutting the victim in the casket.
She was sentenced to 20 years in prison and released after 4, after arguing the state didn’t have jurisdiction to prosecute her because the victim had 1/64 Indian blood and the crime occurred within the borders of the Creek Nation.
The appeals court agreed, based on the U.S. Supreme Court’s decision about state and tribal jurisdiction.
Federal prosecutors could not pick up the case because the statute of limitations had expired.
The Tribal courts could not pick up the case because Sims is not Native American.
