A woman sentenced to 107 years for a DUI crash in 2007 that killed 5 people, is headed back to prison after being released twice in the past 4 years.
A jury found Kimberly Graham guilty on March 9, 2009 and on September 1st, 2009, a judge ordered her to serve the 5, 20 year sentences for manslaughter and the 7 year sentence for leaving the scene of the crash, to run back to back.
The U.S. Supreme Court’s ruling on tribal jurisdiction came out in 2020.
Graham appealed based on being a tribal citizen and was initially released.
There have been several appeals along the way and she was sent back to prison and released a second time.
But, recently a federal court determined that since she did not use her tribal status in her initial appeal, she wasn’t allowed to use it 10 years later, so she’s being sent back to prison.
Her attorney disagrees with the decision.
DA Steve Kunzweiler says it’s high time for this case to be settled and for the victims to get their justice of Graham being in prison and serving her entire sentence.
