An Oklahoma prisoner, already serving life without parole for murder, has been charged with murdering a prisoner in the same pod.
The affidavit for Paul Newberry says he wanted to kill everyone in the whole pod that day, but, realized it “clearly ain’t my job to populate hell” so he killed one man instead, a man Newberry claimed was talking about raping girls.
It says Newberry was mad that he couldn’t give moved from the mental health unit where he’d been placed for being suicidal.
It says on that unit, he was mad he couldn’t get soda or pencils, or see a dentist and he had requested to get off the unit and had been denied October 24th.
It says the next day, he used a homemade knife to kill the victim, Timothy Alvarez.
The affidavit says Newberry admitted punching the victim in the face to wake him up, then kicked the victim in the ribs, then handed the knife to the victim and challenged him to use it to get the cell door open.
The affidavit says Newberry was able to avoid the knife by punching and kneeing the victim, then took the knife back and stabbed the victim numerous times, in the head, the eye, both sides and finally, in the neck, where he left the shank, then left the cell.
It says Newberry couldn’t find a guard so he sat and waited about 5 minutes until a nurse walked by and told her he’d killed someone.
His hands and clothes were covered in blood and the staff secured him and found the victim dead in a cell, covered in blood.
The ME ruled the cause of death was blunt force trauma to the head and stab wounds to major organs; lungs, liver and brain.
Newberry had packed up his belongings, believing he would be moving off the unit, after the murder.
It says he had satanic writings on his cell wall and told investigators, he “worships the devil to the full extent.”
He told investigators he would kill any prisoner they put in a cell with him and he wanted to be in solitary and left alone.
He said he wished he wouldn’t have pled guilty to the 2015 murder and gotten life without parole, but, wished he had gotten the death penalty.
Newberry pled guilty to murder, burglary and robbery in Cherokee County in 2015.
