The OK Court of Criminal Appeals has reversed the conviction of a man currently in prison for hitting and killing a 12 year old boy in a crash and initially, leaving the scene.
The Appeals court reversed the 2014 Wagoner County conviction due to the U.S. Supreme Court’s ruling on tribal jurisdiction.
Records show Richard Roth was driving a Chevy Tahoe in Wagoner, when he hit 12 year old Billy Jack Chuculate Lord, who was riding or pushing his bike.
They say Roth first left the scene, then returned with his wife and had a .29 BAC.
He was found guilty of manslaughter and leaving the scene of a fatal crash and sentenced to 19 years in prison.
