A maintenance man has been charged with rape, after a woman says he attacked her in her apartment, while he was doing work there.
The affidavit for Edcar Thomas says on January 5th, he went into her apartment to fix something.
It says she knew him, since he also lived in the apartment above her.
It says she had to lay down because of back pain and Thomas forcibly raped her.
It says she told him to stop, telling him she has stress induced seizures.
Police say while the victim was getting a sexual assault exam, she had a seizure and had to be hospitalized.
Police say they interviewed Thomas and he first said, the woman was having a panic attack and he tried to help her, but she freaked out.
Then, after telling him, she was having an exam, they say Thomas claimed she’d had sex with someone else.
Then, after telling him DNA would prove who had sex with her last, they say Thomas said he’d had sex with her and she freaked out.
Records show he has previous drug convictions dating from 2005 to 2016.
The first degree rape charge is not a conviction.
