Man found guilty of shooting brother during fight over spilled French fries
Christopher Vibbert, now 36, was found guilty of a Level 3 felony count of aggravated battery and a Level 5 felony count of domestic battery, according to the Allen County Prosecutor’s Office.
The jury also found him guilty of using a firearm in the commission of a crime, which will be tacked onto the sentencing as an enhancement.
It was Vibbert himself who called 911 after the Nov. 30, 2022 shooting in the 2300 block of Brooklyn Avenue. According to court documents, he admitted he’d shot his brother in the chest and hand but claimed his brother attacked him first and it was self-defense.
His brother later told investigators he was shot well after the fight. But Vibbert claimed he fired shots directly after being punched by his brother, who was allegedly upset his French fries had been spilled when Vibbert made a sharp turn while driving.
He faces between three and 16 years for the aggravated battery charge; one to six years for domestic battery; and up to 20 years for the firearm enhancement, adding up to 42 years if the judge hands Vibbert the maximum prison time consecutively for each charge. The minimum sentence would be three years.
Vibbert’s sentencing is scheduled for April 10.
