An Oktaha man faces federal murder charges after being accused of shooting two men outside his home Friday night.
The federal affidavit says at 8:36 PM, Kyle Owens’ wife called 911 and although it was hard to understand, said something to the effect of someone trying to run her off the road and people being on her property and her husband having to shoot someone, then there were 4-5 shots heard and the call disconnected.
It says 911 called back and Kyle Owens got on the phone and said “they are dead” and told dispatch the weapon was in a safe place in the home and when asked what happened, replied, “I decline to say over the phone what happened.”
It says at 8:38 PM, a neighbor called 911 and said her neighbor had shot 2 people and they were both in the road.
It says law enforcement arrived and secured the Owens’ home and allowed the children inside to get dressed and go with a relative.
It says they found 2 vehicles and two men dead, Benjamin Hill and Stephen Hill.
It says law enforcement found 28 spend cartridges in and around the crime scene of the drive-way and road leading to Owens’ home.
It says a neighbor provided security footage that captured audio of the shooting.
It says the neighbor reported seeing Stephen Hill at the back of the car with hands up and Owens approaching Hill with a gun, then hearing 2-3 shots, then Hill fell into the ditch.
It says you can hear a woman screaming something to the effect, of “stop, you’re going to jail” and a man saying something to the effect of, “I’m sorry, it was a joke.”
Owens was booked into the Muskogee County jail.
This case is charged in federal court since Owens is a member of the Cherokee Nation and the crime happened within the boundaries of the Muscogee (Creek) Nation Reservation.
