A federal affidavit says an affair turned deadly in Ottawa County and now a husband and wife are in jail and another woman is dead.
OSBI says Jimmy Kelly is charged in federal court with murder and using a gun to commit a violent act and his wife, Charlana Kelly is charged with accessory to felony.
The affidavit says the investigation began November 1st when the body of Tony Moran was found in rural Ottawa County.
It says Moran had been shot twice, once in the mid-abdomen, under her arm, from the front and once above her left eyebrow.
It says Charlana Kelly initially told investigators she had been home all night except one hour to go get dinner and her husband had been home all night as well.
It says a Confidential Informant told agents, Jimmy Kelly had admitted killing someone, saying he’d shot a woman in the head and his wife had shot the victim also.
It says the Informant then recorded a conversation with Kelly and turned it over the investigators.
It says surveillance video shows on October 31st around 11:30pm, Kelly’s truck and his wife’s Dodge Charger were caught on camera passing a storage business about 2 miles from where the victim’s body was found.
It says Jimmy Kelly then told agents he was having an affair with Moran and Kelly’s wife got jealous so he arranged a confrontation between the two women.
It says he and his wife drove their vehicles to an area and the wife waited while he went and picked up Moran and brought her to that area.
It says he told agents at one point during the confrontation, Moran said she’d be better off dead, so he handed her the loaded, cocked gun and she put it to her head and pulled the trigger.
He told them he was so upset she shot herself, that he then shot her in the abdomen.
It says he admitted dragging her body off the road and he and his wife left.
He told investigators he came back once and took the victim’s phone and returned a second time to set her body on fire, but, couldn’t find it, so dumped the gasoline and left.
It says when agents re-interviewed the wife, she did admit she had lied about her husband being home all night, but, says she denied being at the scene, denied driving to the scene, denied shooting anyone and had no idea how her car got there.
