RawNews1st – The affidavit for Gainer says on September 1st, 2018, several witnesses told police they saw Gainer stomping the head of the victim, who was unconscious on the ground and helpless.
They said Gainer was also beating the victim with a metal pole.
It says when officers arrived, Gainer ran and they had to tase him and he had blood on his clothes and shoes.
It says officers recovered a bent, pole with blood on it.
The victim died from his head injuries.
Police say they did not attempt to interview Gainer at the time because of his disoriented mental state.
He was transferred to a hospital in Norman for mental health treatment, where he has been for nearly 4 years until he was recently released.
The hospital notified the DA’s office, which is why the charge was re-filed and a warrant issued and Gainer was taken into custody here.
Records show the following convictions for Gainer in Tulsa County:
1984: arson, 2 year sentence
1986: assault and battery with a dangerous weapon, 2 year sentence
2007: assault and battery with a dangerous weapon, 4 year
sentence
2013: assault with a dangerous weapon; 5 year sentence.
