The major factor in the sentence was that the man fled the scene after the collision.
Trevor Johnson, 25, was charged with four counts, including failing to stop after an accident in the hit-and-run death after the incident last September.
Kymberly Maclary, 33, was walking her two dogs and was in the crosswalk at the Ferguson intersection on Glenway.
Johnson admitted that he hit Maclary and then took off.
”It’s been hard,” said Maclary’s father, Neil Howell. “Especially the past holidays.”
”She was such a kind-hearted person. She just loved everybody and would do anything for anybody,” said Maclary’s mother, Deborah Howell.
Johnson’s attorney argued that his client should not receive jail time because he had the green light, he was not speeding, and toxicology found illegal drugs in the victim’s system.
Leaving the scene was the most important part of the decision for Judge Christopher Wagner.
Wagner also sentenced Johnson’s father, Richard Johnson, to 90 days in jail for helping to cover up the crime.
Johnson’s defense attorney, Richard Goldberg pointed out an ironic twist that the Elder grad had also been run over. Goldberg said that incident left Johnson with a fractured skull and other injuries. He said that incident and another accident at age 17 contributed to mental health issues Johnson suffers from today.
