Quyen Huynh, 38, has maintained that he did nothing wrong in the May 9 death of Liam Sauve, who was found to have ingested so much fentanyl that it amounted to 23 times the dose that would kill an adult, according to a state child fatality report.
Huynh and the boy’s mom, Elizabeth Sauve, 31, were each charged with second-degree manslaughter, accused of acting with such recklessness that they were criminally responsible for Liam’s death.
Neither of their cases has yet been presented to a grand jury. But Huynh remained jailed, anyway, because he was already on probation for a prior driving offense when he was charged in Liam’s death. That amounts to an alleged probation violation.
Huynh was also found to have tested positive for fentanyl while under going drug-treatment as part of his probation, records show.
A judge ordered Huynh brought to court Wednesday for an update in his probation violation case. That’s when defense lawyer Susan Carey updated the judge on the homicide.
Huynh had exercised his right not to participate in a polygraph interview, Carey said in court. She did not say what the interview would have been about, but Huynh would have likely been asked to give his version of what happened at the time of Liam’s death.
