Graham was convicted charged in 2007 in Tulsa County for a drunk driving, hit and run crash that killed 5 people.
In 2009, a jury convicted her and she was given an 107 year prison sentence.
She was released earlier this year, after serving 12 years due to the U.S. Supreme Court ruling on tribal jurisdiction since she’s a member of the Muscogee Nation.
The feds couldn’t pick up the case because their statute of limitations had expired, so it was going to be handled by tribal court.
Then, an OK Appeals Court ruled the Supreme Court’s decision did not apply to past cases, so the DA argued that meant Graham’s original conviction should stand and she should be sent back to prison.
A Tulsa County judge agreed today the conviction should stand but didn’t think the state courts had the authority to have Graham arrested, so Graham will remain free until there is clarification from the courts on exactly what to do next.
The families of the victims say they wanted Graham back in prison to serve her full sentence.
There is another court date in December and we’ll keep following the case.
